NEET UG 2017: MCI Files Review Petition for NEET, SC Agrees for Review

Medical Council Of India (MCI), which is the regulatory body for Medical (MBBS & PG) courses in India, has filled a review petition for National Eligibility Cum Entrance Test (NEET) UG & PG which was scrapped by Supreme Court (SC) of India in July 2013 after receiving objections from Private Medical Colleges & some states.

In 2013 three bench of judges heard the petition filled by Private Colleges & others against MCI decision to hold NEET UG & PG. Two out of three bench passed verdict against the MCI & therefore NEET UG was made voluntarily that year & allowed Private Colleges to conduct their own entrance exams.Read Here

In today’s [11th April, 2016] order, the five judges headed by Justice A R Dave, were unanimous in saying that the July 18, 2013 verdict of the three-judge bench, which had paved the way for private colleges to conduct their own examination, “needs reconsideration” as “the majority view has not taken into consideration some binding precedents”. 

Suffice it is to mention that the majority view has not taken into consideration some binding precedents and more particularly, we find that there was no discussion among the members of the Bench before pronouncement of the judgment,” the apex court said.
We, therefore, allow these review petitions and recall the judgment dated July 18, 2013 and direct that the matters be heard afresh. The review petitions stand disposed of as allowed” it said.

“Till the matter is decided, NEET can be implemented,” the SC said while hearing a review petition.

So, now it has opened a fresh door for discussion on NEET. It is less likely to be implemented from this year as the exams have been scheduled & any movement from it is likely to cause more controversies & more petition being filled in Supreme Court, as it has been earlier. But certainly it is likely to be implemented from 2017 if everything goes right. Ministry has also done amendment to certain laws in favour of MCI, to allow it to conduct NEET UG & PG.

    It is not good that court will take such a decision 2 days before the scheduled examination after all many student waste their time by previous examination in statepmts and all

      Most likely…But can’t confirm yet as the matter is in court.
